{"id":92,"date":"2023-10-14T15:18:45","date_gmt":"2023-10-14T05:18:45","guid":{"rendered":"https:\/\/www.edswimming.com.au\/?page_id=92"},"modified":"2026-07-23T09:44:41","modified_gmt":"2026-07-22T23:44:41","slug":"terms-conditions","status":"publish","type":"page","link":"https:\/\/www.edswimming.com.au\/?page_id=92","title":{"rendered":"Terms &#038; Conditions"},"content":{"rendered":"\n<ol type=\"1\">\n<li><strong>Conduct<\/strong><\/li>\n<\/ol>\n\n\n\n<p>The terms and conditions in order to ensure the safety and enjoyment of participants at all times.<\/p>\n\n\n\n<ol type=\"1\">\n<li>For the welfare of everyone attending, rude, disrespectful or unsafe behaviour will not be tolerated.<\/li>\n<\/ol>\n\n\n\n<ol type=\"1\">\n<li>&nbsp;If a child displays behaviour in a class and is disruptive to other participants then the instructor can terminate the client\u2019s participation for a period and if behaviour is repeated the client may no longer be able to participate in lessons.<\/li>\n<\/ol>\n\n\n\n<ol type=\"1\">\n<li>Any adult who displays unruly, disruptive, aggressive, unsafe or disrespectful type of behaviour shall be asked to leave the premise immediately with the participant.<\/li>\n<\/ol>\n\n\n\n<ol type=\"1\">\n<li>No refunds will be given for a child or adult who has a class terminated due to nonadherence to the terms and conditions.<\/li>\n<\/ol>\n\n\n\n<ul>\n<li><strong>Supervision<\/strong><\/li>\n<\/ul>\n\n\n\n<ul>\n<li>The instructor is accredited to ensure the safety of the client, however, a supervising adult who attends with any children share the responsibility with the instructor for the client safety in accordance with terms and conditions.<\/li>\n<\/ul>\n\n\n\n<ul>\n<li>During the swimming lesson the supervising adult must actively supervise, remaining in the pool area, and maintaining visual contact with the client and be easily contacted by the instructor.<\/li>\n<\/ul>\n\n\n\n<ul>\n<li>The supervising adult will also ensure that any other sibling are properly supervised in the vicinity of the pool at all times.<\/li>\n<\/ul>\n\n\n\n<ul>\n<li><strong>Health and Safety<\/strong><\/li>\n<\/ul>\n\n\n\n<ul>\n<li>The supervising adult will ensure that the client does not enter the water before the teacher instructs them to do so or after the teacher advises them to remove themselves from the pool.<\/li>\n<\/ul>\n\n\n\n<ul>\n<li>The supervising adult will ensure that the client and themselves follow all rules directions by the teacher for the benefit of the student. The supervising adult will not allow the children to run around the pool area, nor consume food or drink in the pool area and ensure that children who are sick do not attend a lesson and any open skin wounds are appropriately covered prior to the commencing of a lesson.<\/li>\n<\/ul>\n\n\n\n<ul>\n<li>The client or care giver shall not smoke or consume alcohol or be affected by alcohol or any other illicit substance whilst in the centre.<\/li>\n<\/ul>\n\n\n\n<ul>\n<li><strong>Payment and Fees<\/strong><\/li>\n<\/ul>\n\n\n\n<ul>\n<li>All lessons must be paid for in full when the client is booking into lessons.<\/li>\n<\/ul>\n\n\n\n<ul>\n<li><strong>Credit<\/strong><\/li>\n<\/ul>\n\n\n\n<ul>\n<li>If the provider cancels lesson due to unforeseen circumstances a credit will be issued to the client.<\/li>\n<\/ul>\n\n\n\n<ul>\n<li>All clients are entitled to one (1) credit per term, unless we are provided with a medical certificate. <strong>We are unable to offer makeup lessons.<\/strong><\/li>\n<\/ul>\n\n\n\n<ul>\n<li>If the client unenrolls before the term is finished, the client is entitled Fifty percent (50%) of the remaining lesson price total.<\/li>\n<\/ul>\n\n\n\n<ul>\n<li><strong>Confidentiality<\/strong><\/li>\n<\/ul>\n\n\n\n<ul>\n<li>If a caregiver takes photos during classes the caregiver must minimise the photo to that of your child only and are not including other children in the photo to respect the privacy of our other families. No photography\/video recording is allowed in or near any change rooms or change areas. No photography or videos of other children may be posted to any form of social media.<\/li>\n<\/ul>\n\n\n\n<ul>\n<li><strong>Variation<\/strong><\/li>\n<\/ul>\n\n\n\n<ul>\n<li>We may change these terms and conditions at any time by providing you at least 30 days written notice. If you wish to cancel as a result of those changes you may do so by giving notice to the provider in accordance with the terms herein.<\/li>\n<\/ul>\n\n\n\n<ul>\n<li><strong>Medical<\/strong><\/li>\n<\/ul>\n\n\n\n<ul>\n<li>The client and\/or caregiver warrant that the client has no medical condition that may affect their ability to participate in swimming lessons except as disclosed on the membership application. If the student does have a medical condition, you warrant that the medical condition has been assessed by a medical practitioner by AHPRA who has advised that it is safe for the student to participate in swimming lessons and related services.\n<ul>\n<li>The client caregiver consents to the student receiving emergency medical treatment in the event of injury or illness whilst at the swimming lesson.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<ul>\n<li><strong>Disclaimer<\/strong><\/li>\n<\/ul>\n\n\n\n<ul>\n<li>Although we take all reasonable care in providing swimming lessons and related services, you acknowledge that these activities involve inherit risk of injury.<\/li>\n<\/ul>\n\n\n\n<ol type=\"1\">\n<li><strong>Waiver<\/strong><\/li>\n<\/ol>\n\n\n\n<p>10.1&nbsp; The maximum extent permitted by law, you and the client expressly release us and our staff from all claims and demands (including negligence) arising from you or the client\u2019s participation in activities or use of the facilities, under this agreement, that results in any personal injury or death.<\/p>\n\n\n\n<ol type=\"1\">\n<li><strong>Off site lessons (At home lessons) (1<sup>st<\/sup> July 2026)<\/strong><\/li>\n<\/ol>\n\n\n\n<p>By agreement, lessons conducted at private premises are subject to approval by the provider.<\/p>\n\n\n\n<p>For lessons provided at a private residence, the owner or nominated supervisor at the property will warrant as follows:<\/p>\n\n\n\n<p>11.1 They have properly maintained the pool by;<\/p>\n\n\n\n<p>11.2 That the pool is safe to swim in and suitable for the use that they accept the provider and the students and\/or caregivers at the premises for the provision of the service;<\/p>\n\n\n\n<p>11.3 That the provider will conduct a risk assessment of the premises prior to commencement of any service and can terminate the provision of the service if the premises is not suitable;<\/p>\n\n\n\n<p>11.4 The provider takes no responsibility for any damage to the property caused by persons, caregivers and or clients of the&nbsp; service; and<\/p>\n\n\n\n<p>11.5 The owner of the private property or nominated supervisor will indemnify the provider for any claims or demands made against the provider as a result of the provision of any services under this agreement.<\/p>\n\n\n\n<p>&nbsp;11.6 The provider will invoice the client the fee of services every Friday for the week just been (Friday \u2013 Friday) Each lesson will be for the period of 30 minutes (There is a surcharge of 1.8% of the invoice payment amount and a 25c transaction fee.)<\/p>\n\n\n\n<p>11.7 The client\/caregiver will pay for the service in full after the commencement of the lesson through the invoice that will be sent to them by the provider. No cash will be accepted by the provider or the providers representative. Failure to pay by the due date will result in the provider sending One (1) reminder to the client. The client has One (1) week to pay the overdue invoice. Failure to do so will result in the provider referring the matter to a Debt Collector at the clients expense (Client will pay any and all debt collection costs, interest and expenses including any and all commission on any and all unpaid accounts).<\/p>\n\n\n\n<p>11.8 Each client is entitled to Two (2) free cancellations per quarter (only if the provider is given One (1) hours\u2019 notice, failure to do so will result in a Fifty percent (50%) charge of the total lesson amount)<\/p>\n\n\n\n<p>11.9 Thereafter, If the Client is to cancel their lesson, they must give the provider a minimum of Twenty Four hours\u2019 (24Hrs ) notice. The client will still be charged for Fifty percent (50%) of the total lesson amount. Failure to do so will result in the client still being charged the total amount for the lesson. If the Client gives the provider more than Twenty Four hours\u2019(24Hrs) they will also still be charged Fifty percent (50%) of the lesson total.<\/p>\n\n\n\n<p>11.10 The only exception to sections 11.8 and 11.9 is weather. This will be decided between the client and provider on the day of this lesson.<\/p>\n\n\n\n<ol type=\"1\">\n<li><strong>Equipment<\/strong><\/li>\n<\/ol>\n\n\n\n<ol type=\"1\">\n<li>&nbsp;All equipment that the provider brings to the service belongs to the provider and will be returned at the completion of each service.
